Power of Attorney Guide & Checklist

POA type comparison (General vs Specific), step-by-step process (drafting → notarization → registration → revocation), and use-case-specific checklist for property, NRI, business, court, and bank.

Step-by-step process

1

Consult advocate/CA for drafting

Professional drafting ensures legally valid language. Cost: ₹1,000–₹5,000 for advocate. Avoid using generic templates without review — small errors invalidate the document.

2

Obtain stamp paper from bank/e-GRAS

Purchase appropriate value e-stamp paper from authorized vendor or government e-GRAS portal. Keep the receipt. Stamp paper must be from the state where the POA is being executed.

3

Principal and two witnesses sign POA

Principal signs on stamp paper in presence of notary and witnesses. Witnesses sign as attestors. Photographs of principal and donee typically affixed for property POA.

POA is a legal document — always draft with professional help. A poorly drafted or unregistered POA for property transactions can lead to legal disputes, title issues, and financial loss. The cost of a lawyer (₹2K–₹10K) is far less than the cost of rectifying a bad POA.
